What estate planning services does Mahover Law offer?

Mahover Law assists clients with wills, revocable and irrevocable trusts, powers of attorney, health care directives, beneficiary planning, trust funding. and other estate planning strategies tailored to each client’s family, assets, and goals.

Do I need a Will or a Revocable Living Trust?

The answer depends on your assets, family circumstances, and planning goals. A Will directs how probate assets are distributed after death, while a properly funded Revocable Living Trust can provide additional flexibility and may allow certain assets to pass outside of probate. We help clients determine which approach best fits their circumstances.

How does estate planning work for blended families, second marriages, or unmarried couples?

These family structures often require more customized planning. An estate plan can help balance the interests of a spouse or partner, children from prior relationships, shared children, and other beneficiaries while clearly documenting your wishes and minimizing potential conflict.

Can estate planning address the future of my family business or business interests?

Yes. Succession planning can address how ownership and control of a business will transition in the event of death, incapacity, or retirement. Estate planning can be coordinated with business agreements and other succession strategies to help protect the business and provide continuity for the next generation.

What is the difference between probate and administration?

Probate generally occurs when a person dies with a valid Will and the Will must be admitted by the court. Administration generally applies when someone dies without a Will. In either situation, the estate representative is responsible for identifying assets, addressing debts and expenses, and ultimately distributing the estate to the appropriate beneficiaries or heirs.

How long does probate or estate administration take in New York?

In New York, probate or estate administration can often take 9-12 months or longer, depending on the circumstances of the estate. Delays may result from Surrogate’s Court processing times, difficulty locating heirs or beneficiaries, collecting and valuing assets, creditor claims, tax matters, the sale of real estate, or disputes among interested parties.

Can probate be avoided?

Certain assets may pass outside of probate through a properly funded trust, beneficiary designation, joint ownership, or other planning techniques. Whether avoiding probate should be a goal depends on your particular assets and circumstances.

When should I update my estate plan?

You should review your estate plan after significant life changes such as marriage, divorce, the birth or adoption of a child, a second marriage, the death of a beneficiary or fiduciary, the purchase or sale of significant assets, changes in business ownership, or substantial changes in your financial circumstances. Periodic reviews are also recommended.

What happens if I die without a Will or estate plan?

If you die without a valid Will, state law determines who receives assets that are subject to the estate administration process. Those rules may not reflect your personal wishes, particularly for unmarried partners, blended families, or individuals with other unique family circumstances.

How should I prepare for an estate planning consultation?

It is helpful to have a general understanding of your assets, how they are titled, any existing estate planning documents, beneficiary designations, family relationships, and the individuals you may want to name to make financial or health care decisions on your behalf. We will guide you through the remaining information needed to develop your estate plan.
